DEED Releases Proposed Rules to Paid Leave Program
The Minnesota Department of Employment and Economic Development has proposed rules to clarify various topics related to implementation of the paid leave program starting in 2026.
The Minnesota Department of Employment and Economic Development (DEED) has issued a notice of intent to adopt expedited rules (pdf) concerning the Minnesota Family and Medical Benefit Insurance program. By following the expedited rulemaking process, DEED will not have public hearings concerning its proposal, but there is an open public comment period with a deadline of Jan. 3, 2025.
The proposed paid leave program rules (pdf) offer clarification on numerous topics, including:
- Seasonal employees.
- Covered individuals’ notice to employer.
- Supplemental benefits designation.
- Schedule modifications.
- Intermittent leave.
- Private plans.
Following the comment period, DEED will consider modifications to the proposed rules and then issue a final set of rules prior to the program going into effect on Jan. 1, 2026.
Submit comments to DEED by Jan. 3
Cities that are interested in submitting comments on the proposed paid leave program rules can do so by the Jan. 3, 2025, deadline. All comments should be delivered in writing and should identify the portion of the proposed rules being addressed and the reason for the comment. Comments can be submitted electronically on the Office of Administrative Hearing website or by delivering them to the Office of Administrative Hearings at:
