Focus on New Laws: Rental Licensing Prohibition for Certain Group Assisted Living Facilities
Group homes with six or fewer residents are now exempt from city-imposed rental licensing requirements.
A new law was passed during the 2024 legislative session, included in Chapter 108, that prohibits all cities from subjecting certain state-licensed group assisted living facilities from rental licensing requirements.
As of May 18, 2024, state-licensed group assisted living facilities (commonly referred to as group homes) licensed under Minnesota Statutes 144G.45 and 245D.02 with six or fewer residents are exempt from town, municipality, or county-imposed rental licensing requirements. Group assisted living facilities subject to the exemption must still comply with all applicable state and local governing law, regulations, standards, and ordinances, including fire safety and building codes, and zoning requirements.
